Warning on prohibited and restricted chemicals under new regulations

Plastic manufacturing businesses must pay special attention to prohibited and restricted chemicals. Legal regulations and safety standards are increasingly stringent to protect human health and the environment. These regulations apply not only in Vietnam but also align with international standards. Non-compliance can lead to severe consequences. Understanding and staying updated on prohibited and restricted chemicals is critical for business survival.

SUMMARY OF NEWLY PROHIBITED AND RESTRICTED CHEMICAL GROUPS

The list of prohibited and restricted chemicals is regularly updated under Vietnamese regulations and international standards. Notable chemical groups include phthalates, heavy metals such as lead (Pb), cadmium (Cd), mercury (Hg), and halogenated flame retardants like polybrominated diphenyl ethers (PBDE).

  • Phthalates, commonly used as plasticizers in PVC, are restricted in children’s toys and food packaging. They pose risks of endocrine disruption and adverse effects on reproductive health.
  • Heavy metals like lead and cadmium, often found in pigments or stabilizers, are neurotoxic and bioaccumulative, threatening human health.
  • Mercury, though rarely used in plastics, is strictly controlled due to its severe impact on the nervous system.
  • Halogenated flame retardants, such as PBDE, are restricted in electronic products due to toxic fumes released during combustion and environmental pollution.

These chemicals are banned or restricted in sectors like food packaging, toys, electronics, and consumer goods. Businesses should refer to Decree 113/2017/ND-CP, Annex III, for the specific list.

RISKS OF USING PROHIBITED AND RESTRICTED CHEMICALS

Using prohibited or restricted chemicals poses significant risks. Non-compliant products may be recalled or banned from circulation, leading to substantial financial losses and supply chain disruptions.

Toxic chemicals directly impact consumer health, causing endocrine disruption, neurological damage, or cancer. Environmental concerns are also critical, as these chemicals accumulate in soil and water, causing long-term pollution.

A violation involving prohibited chemicals can erode customer and partner trust. Businesses may face heavy fines or legal liability. Violating international standards like REACH or RoHS can result in severe consequences, such as export bans or litigation.

Transitioning to safe, eco-friendly additives and chemicals is an effective solution. Many alternative additives are being developed to meet safety requirements. Adopting these solutions ensures compliance while enhancing brand value.
