Chemical Law 2025 in Vietnam: Key Updates and Its Impact on Industry

The Chemical Law 2025 in Vietnam (No. 69/2025/QH15) marks a significant milestone in chemical management in Vietnam. Passed by the National Assembly on June 14, 2025, it takes effect from January 1, 2026. OVERVIEW OF CHEMICAL LAW 2025

The Chemical Law 2025 replaces the Chemical Law 2007, addressing modern management needs. Comprising 7 chapters and 48 articles, it is streamlined by 4 articles from the draft. Its objectives include ensuring chemical safety, protecting the environment, and promoting sustainable development. The chemical industry plays a vital role in Vietnam’s economy. Thus, this law establishes a clear and transparent legal framework.

The law regulates activities related to chemical production, trading, and use. Notably, hazardous chemicals are subject to stricter oversight. New provisions reduce risks to human health. They also enhance protection for the environment and property. Additionally, the law aligns with global standards, facilitating international integration.

KEY HIGHLIGHTS OF CHEMICAL LAW 2025 

Prohibited Acts

The Chemical Law 2025 lists seven prohibited acts, up from four previously. These include:
– Illegal possession of chemicals.
– Producing or trading hazardous chemicals without permits.
– Providing false information about chemical properties.
– Using chemicals of unknown origin in food or pharmaceuticals.

Conditions for Chemical Production and Trading

Businesses engaged in chemical production or trading must meet stringent conditions. Organizations must be legally established with compliant facilities. Safety documentation and technical qualifications are mandatory. For restricted chemicals, a certificate of eligibility is required. This certificate, issued by provincial People’s Committees, is valid for five years.

Highly controlled chemicals require permits from ministerial-level authorities, also valid for five years. For banned chemicals, permits last only 12 months. These regulations ensure safety in chemical production and trading.

Chemical Traceability

A significant new provision is the requirement for chemical traceability. Highly controlled chemicals must have publicly disclosed information. Businesses must register on the National Chemical Database, detailing chemical types and usage purposes. This must be done before initial use.

Companies trading highly controlled chemicals must maintain Control Records. These records document each transaction’s details. This enables authorities to monitor and manage chemical activities effectively. Electronic invoicing is also proposed to enhance transparency. These measures ensure chemical safety and security.

Development of the Chemical Industry

The Chemical Law 2025 emphasizes sustainable development of the chemical industry. A development strategy, approved by the Prime Minister, spans 10 years with a 30-year vision. It aims to meet national defense, security, and environmental protection needs. Simultaneously, it supports economic growth.

Businesses are provided favorable conditions for development. The law encourages adopting modern, eco-friendly technologies. This facilitates Vietnam’s deeper integration into global markets. The chemical industry will play a pivotal role from 2026 to 2030.

Transitional Provisions

The Chemical Law 2025 includes transitional provisions for feasibility. Investment projects initiated before January 1, 2026, follow existing laws. Current permits and certificates remain valid until expiration. For highly controlled chemicals, compliance is extended to December 31, 2026. Restricted chemicals have until December 31, 2027. These provisions allow businesses time to prepare.
